<\/span>CONSTITUTIONAL LAW AGAINST BLOCKING FOR NATIONAL DEVELOPMENT<\/span> AND GUARANTEE OF HUMAN RIGHTS<\/span><\/span>

 <\/p>\n

The Constitutional Law against Blocking for National Development and Guarantee of Human Rights, issued by the National Constituent Assembly, was published in Official Gazette No. 6.583 Extraordinary of October 12, 2020 (the \u201cConstitutional Law\u201d).<\/span><\/span><\/span><\/span><\/span><\/p>\n

Object of the Constitutional Law<\/span><\/span><\/span><\/strong><\/span><\/span><\/p>\n

To establish a special and temporary regulatory framework that provides the Venezuelan National Government, with legal tools for counteracting, mitigating, and reducing the effects derived from the imposition, on the Republic of Venezuela and its population, of unilateral coercive and other restrictive or punitive measures (measures defined in the Constitutional Law) issued by another State or group of States, or from acts or omissions of said States, by international organizations or other public or private foreign entities.<\/span><\/span><\/span><\/span><\/span><\/p>\n

Scope of Application<\/span><\/span><\/span><\/strong><\/span><\/span><\/p>\n

The provisions of the Constitutional Law are of public order and general interest and they will be applied by all branches of the National Government, in its national, state, and municipal ambit, as well as by public and private, natural and legal persons in all of the national territory.<\/span><\/span><\/span><\/span><\/span><\/p>\n

Purpose of the Constitutional Law<\/span><\/span><\/span><\/strong><\/p>\n

    \n
  1. T<\/span>o assure the full enjoyment of the human rights of Venezuelan population in the face of the unilateral coercive<\/span> and other restrictive or punitive measures adopted against the country or its nationals.<\/span><\/span><\/li>\n
  2. To favor a harmonious development of national economy aimed at creating job opportunities, high national added<\/span> value, raising the living standards of population, and strengthening the<\/span> country\u2019s<\/span> economic and technological <\/span>sovereignty.<\/span><\/span><\/span><\/span><\/span><\/li>\n
  3. T<\/span>o assure the full performance of the right of Venezuelan people to self-determination, including their <\/span>untransferable right to full sovereignty over all their wealth and natural resources.<\/span><\/span><\/span><\/li>\n<\/ol>\n

    <\/span>Subsequent Control<\/span><\/span><\/span><\/strong><\/span><\/span><\/p>\n

    All public acts issued by application of the Constitutional Law are subject to the subsequent control of the <\/span>Comptroller General\u2019s Office<\/span> of the Republic.<\/span><\/span><\/span><\/p>\n

    International Center of Productive Investment<\/span><\/span><\/span><\/strong><\/span><\/span><\/p>\n

    The Constitutional Law prescribes that the International Center of Productive Investment will be created, as an entity<\/span> in charge of recording, studying, and monitoring the unilateral coercive and other restrictive or punitive measures,<\/span> evaluating, approving, and promoting the productive projects derived from the application of the Constitutional Law<\/span> and managing the Nation Branding, as a strategy oriented to the promotion of investments and foreign trade.<\/span><\/span><\/span><\/span><\/p>\n

    Said International Center was created through a Constituent Decree published in the same Official Gazette in which <\/span>the Constitutional Law was published.<\/span><\/span><\/p>\n
