<\/span><\/span><\/span><\/span>STATE OF NATIONAL ALARM TO ATTEND TO THE CORONAVIRUS COVID -19<\/span><\/span> SANITARY EMERGENCY<\/span><\/span><\/strong><\/span><\/span><\/span><\/p>\n


Presidential Decree No. 4.198 was published in Official Gazette No. 6.535 Extraordinary of May 12, 2020.<\/span> Through said Decree, the State of Alarm to Attend to the Coronavirus COVID-19 Sanitary Emergency was<\/span> declared (the \u00abDecree\u00bb).<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

On<\/span><\/span> March 13, 2020,<\/span><\/span><\/span> the first<\/span><\/span><\/span> Decree of State of Alarm to attend to the Coronavirus COVID<\/span><\/span>–<\/span><\/span>19 Sanitary<\/span><\/span> Emergency in Venezuela<\/span><\/span> was<\/span><\/span><\/span> issued.<\/span><\/span> Its period of time was subsequently extended<\/span><\/span>.<\/span><\/span><\/span><\/span><\/span><\/span>
The State of Alarm is a type of state of emergency established in the<\/span><\/span> National Constitution, through which the <\/span><\/span>constitutional rights may be temporarily restricted. Said state of emergency will last up to thirty days and may<\/span><\/span> be extended for up to thirty days<\/span><\/span><\/span> more<\/span><\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

Following are the most important aspects of the Decree:<\/span><\/span><\/span><\/span><\/span><\/p>\n

Purpose of the Decree<\/span><\/span><\/strong><\/span><\/span><\/span><\/p>\n

To declare the State of Alarm in all of the national territory, given the social circumstances that seriously risk<\/span> the public health and safety of the inhabitants of the Republic of Venezuela, in order for the National Executive<\/span> to adopt the urgent, effective, and necessary measures for protecting and preserving Venezuelan population’s<\/span> health, with the purpose of mitigating and eradicating the risks of epidemic related to the coronavirus COVID –<\/span>19 and its possible strains, assuring opportune, efficacious, and efficient attention to the cases that arise.<\/span><\/span><\/span><\/span><\/span><\/p>\n

Persons\/entities subject to the Decree<\/span><\/span><\/strong><\/span><\/span><\/span><\/p>\n

1.<\/span> All authorities of the Venezuelan National Government, in their national, state, and municipal ambits,<\/span> will urgently comply with the Decree as a priority and will keep the National Executive opportunely<\/span> informed, through the Executive Vice-presidency, of all situations under the jurisdiction of the same that<\/span> are or may be affected by the risks of the coronavirus COVID -19 epidemic.<\/span><\/span><\/span><\/span><\/span><\/p>\n

The Executive Vice-president of the Republic of Venezuela and the Ministers, in the frame of their <\/span>competence, will develop, through resolutions, the necessary measures established in the Decree.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n

<\/span><\/span><\/span><\/span><\/span>2.<\/span> The natural persons, as well as the private legal persons, are under the obligation to comply with the<\/span> provisions of the Decree. They will be individually liable when their non-compliance risks the citizens’<\/span> health or the full execution of the provisions of the Decree. Said persons must cooperate when for urgent<\/span> reasons their cooperation is required by the competent authorities.<\/span><\/span><\/span><\/span><\/span><\/p>\n

Immediate Preventive Measures<\/span><\/span><\/strong><\/span><\/span><\/span><\/p>\n

1.<\/span> The health system continues to be in permanent emergency for the prevention of and attention to the<\/span> cases that may arise. All sanitary authorities, public officers and servants of the public health<\/span> establishments, in the national, state, and municipal ambits, will obey the direct orders issued by the<\/span> Ministry of the Popular Power for Health, to the extent that they are necessary to respond to the sanitary<\/span> emergency declared.<\/span><\/span><\/span><\/span><\/span><\/p>\n

2.<\/span> The information about the public and private health centers designated and operating to conduct the<\/span> process of attention to the cases detected and to be diagnosed must be daily updated.<\/span><\/span><\/span><\/span><\/span><\/p>\n

3.<\/span> The<\/span> President<\/span> of<\/span> the<\/span> Republic<\/span> of<\/span> Venezuela<\/span> may<\/span> order<\/span> restrictions<\/span> on<\/span> circulation<\/span> in<\/span> specific<\/span> geographical areas or zones, as well as the entry to or exit from the same, when necessary as a measure<\/span> for protection against or containment of the coronavirus COVID -19.<\/span><\/span><\/span><\/p>\n

The acts of the National Executive through which the aforesaid restrictions are established will provide for <\/span><\/span><\/span>alternative measures allowing the circulation of vehicles and pedestrians for the acquisition of essential goods:<\/span> food, medicines, medical products; the transportation to healthcare centers; the transportation of physicians,<\/span> nurses, and other workers of health services; the transportation and movement of vehicles and persons by reason<\/span> of the activities that may not be suspended according to the current legislation, as well as the establishment of<\/span> routes\/corridors designated for sanitary purposes, when necessary.<\/span><\/span><\/span><\/span><\/span><\/p>\n

4.<\/span> The President of the Republic of Venezuela may order the suspension of activities in specific<\/span> geographical zones or areas. Said suspension also involves the suspension of labor activities the<\/span> performance of which is not possible under any remote method that allows the worker to perform his\/her<\/span> work from home.<\/span><\/span><\/span><\/span><\/span><\/p>\n

5.<\/span> The following will not be subject to suspension of activities:<\/span><\/span><\/span><\/span><\/p>\n
