{"id":5605,"date":"2020-03-23T10:39:38","date_gmt":"2020-03-23T14:39:38","guid":{"rendered":"https:\/\/www.traviesoevans.com\/travieso\/?p=5605"},"modified":"2022-05-23T06:03:33","modified_gmt":"2022-05-23T10:03:33","slug":"suspension-of-real-property-rental-payment-mar-23-2020","status":"publish","type":"post","link":"https:\/\/www.traviesoevans.com\/travieso\/en\/suspension-of-real-property-rental-payment-mar-23-2020\/","title":{"rendered":"SUSPENSION OF REAL PROPERTY RENTAL PAYMENT &#8211; Mar 23 2020"},"content":{"rendered":"<p style=\"text-align: center;\"><strong><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-3878 size-full\" src=\"https:\/\/www.traviesoevans.com\/travieso\/wp-content\/uploads\/2021\/03\/Alert-768x127.jpg\" alt=\"\" width=\"815\" height=\"135\" \/><\/strong><\/p>\n<p style=\"text-align: center;\"><span id=\"page12R_mcid0\" class=\"markedContent\"><\/span><strong><span id=\"page12R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">SUSPENSION OF REAL PROPERTY RENTAL PAYMENT<\/span><\/span><span id=\"page12R_mcid5\" class=\"markedContent\"><\/span><\/strong><span id=\"page12R_mcid6\" class=\"markedContent\"><\/span><\/p>\n<div id=\"sidebarContainer\">\n<div id=\"toolbarSidebar\">\n<div id=\"toolbarSidebarRight\"><\/div>\n<\/div>\n<div id=\"sidebarContent\">\n<div id=\"thumbnailView\">\n<div class=\"thumbnail selected\" data-page-number=\"1\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p style=\"text-align: justify;\"><span class=\"markedContent\"><span id=\"page12R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Resolution No. 023, issued by the Ministry of the Popular Power for Habitat and Housing, was published in<\/span> <span dir=\"ltr\" role=\"presentation\">Official Gazette No. 41.852 of April 1, 2020<\/span> <span dir=\"ltr\" role=\"presentation\">(the \u201cResolution\u201d).<\/span> <span dir=\"ltr\" role=\"presentation\">The Resolution suspended up to September 1,<\/span> <span dir=\"ltr\" role=\"presentation\">2020, the payment of rentals of real property used as principal dwelling house.<\/span><\/span><span id=\"page12R_mcid7\" class=\"markedContent\"><\/span><span id=\"page12R_mcid8\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span class=\"markedContent\"><span id=\"page12R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Resolution established that Principal Dwelling House will be understood as a dwelling house that is<\/span> <span dir=\"ltr\" role=\"presentation\">generally and permanently occupied, which condition is to be proven to the National Superintendence of<\/span> <span dir=\"ltr\" role=\"presentation\">Dwelling House Lease (<\/span><span dir=\"ltr\" role=\"presentation\">Superintendencia Nacional de Arrendamientos de Vivienda<\/span> <span dir=\"ltr\" role=\"presentation\">&#8211; SUNAVI) by the parties.<\/span><\/span><span id=\"page12R_mcid9\" class=\"markedContent\"><\/span><span id=\"page12R_mcid10\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span class=\"markedContent\"><span id=\"page12R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">By virtue of the suspension established by the Resolution, the Ministry of the Popular Power for Habitat and<\/span> <span dir=\"ltr\" role=\"presentation\">Housing, acting through its assigned entity, the National Superintendence of Dwelling House Lease (SUNAVI),<\/span> <span dir=\"ltr\" role=\"presentation\">will proceed to establish the specific conditions for the implementation of the payment of the rentals as per the<\/span> <span dir=\"ltr\" role=\"presentation\">methods established in the Decree, which are listed below:<\/span><\/span><span id=\"page12R_mcid11\" class=\"markedContent\"><\/span><span id=\"page12R_mcid12\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span class=\"markedContent\"><span id=\"page12R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">Payment of the rentals may be restructured or financed through an agreement between the parties<\/span> <span dir=\"ltr\" role=\"presentation\">(lessor-lessee). This restructuring or financing may not end at the time when the period of time<\/span> <span dir=\"ltr\" role=\"presentation\">prescribed in the Decree for suspension of the payments ends, that is, the full payment of the rentals may<\/span> <span dir=\"ltr\" role=\"presentation\">not be immediately required upon the end of the suspension.<\/span><\/span><span id=\"page12R_mcid13\" class=\"markedContent\"><\/span><span id=\"page12R_mcid14\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span class=\"markedContent\"><span id=\"page12R_mcid14\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">A gradual and progressive payment of the rental may be established through percentages allowing the<\/span> <span dir=\"ltr\" role=\"presentation\">full payment of the whole amount of the suspended payment. These percentages will vary with the<\/span> <span dir=\"ltr\" role=\"presentation\">consensus of the parties, starting with the payment of ten percent (10%) and successively increasing<\/span> <span dir=\"ltr\" role=\"presentation\">said percentage until reaching the total amount of the rentals not received by lessor.<\/span><\/span><span id=\"page12R_mcid15\" class=\"markedContent\"><\/span><span id=\"page12R_mcid16\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span class=\"markedContent\"><span id=\"page12R_mcid16\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">Likewise, the parties may establish as payment method, after the suspension has ceased, a double<\/span> <span dir=\"ltr\" role=\"presentation\">monthly payment of the rental until reaching the total amount not received by lessor.<\/span><\/span><span id=\"page12R_mcid17\" class=\"markedContent\"><\/span><span id=\"page12R_mcid18\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span class=\"markedContent\"><span id=\"page12R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">The deposit or advance fund may also be established as payment method when a fund to that end is<\/span> <span dir=\"ltr\" role=\"presentation\">created, in which fund the parties establish that the money deposited, whatever the amount of the same<\/span> <span dir=\"ltr\" role=\"presentation\">may be, and even if the fund was created before the suspension, will be used to pay the rentals accrued <\/span><span dir=\"ltr\" role=\"presentation\">during the suspension.<\/span><\/span><span id=\"page12R_mcid19\" class=\"markedContent\"><\/span><span id=\"page12R_mcid20\" class=\"markedContent\"><\/span><span id=\"page12R_mcid21\" class=\"markedContent\"><\/span><span id=\"page12R_mcid22\" class=\"markedContent\"><\/span><span id=\"page12R_mcid23\" class=\"markedContent\"><\/span><span id=\"page12R_mcid24\" class=\"markedContent\"><\/span><span id=\"page12R_mcid25\" class=\"markedContent\"><\/span><span id=\"page12R_mcid26\" class=\"markedContent\"><\/span><span id=\"page12R_mcid27\" class=\"markedContent\"><\/span><span id=\"page12R_mcid28\" class=\"markedContent\"><\/span><span id=\"page12R_mcid29\" class=\"markedContent\"><\/span><span id=\"page12R_mcid30\" class=\"markedContent\"><\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span class=\"markedContent\"><span id=\"page26R_mcid0\" class=\"markedContent\"><\/span><span id=\"page26R_mcid1\" class=\"markedContent\"><\/span><span id=\"page26R_mcid2\" class=\"markedContent\"><\/span><span id=\"page26R_mcid3\" class=\"markedContent\"><\/span><span id=\"page26R_mcid4\" class=\"markedContent\"><\/span><span id=\"page26R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">Payment of special installments by lessee may be established as another form of rental payment<\/span> <span dir=\"ltr\" role=\"presentation\">restructuring, which installments will be set during the agreement of suspension.
